A one year countdown starts whenever I post anything directly describing my for sale unpatented device in DETAIL or post a video on the You Tube describing it. That means its PUBLIC DOMAIN and I have 1 year to patent it from date of posting. No one except me as the original inventor can do this during that 1 year time frame. After that the device is fair game for anyone to patent.
A patent lawyer gave me that advice.

What worries me with that advice is if the invents act is passed and it has already passed several hurdles it may render that advice obsolete. also it may only apply for the US, if you are not a US citizen, you may not be covered by the first to invent rule.

So I only say this so you tread with caution.

A provisional patent provides the protection you need and is reasonably cheap. Like the advice given it gives you 12 months of guaranteed protection... In America only.

On the perpetual motion machine question If you can't prove where the energy comes from you can't patent it. Even if you prove it works, saying its Zero Point Energy or whatever still won't work. I have heard of patents being denied (think Moray radiant energy device http://thmoray.org/). I believe its a law that actually prevents PM devices being patented, so the patent offices arm is twisted and has no choice.

This patent by the way clearly does not work. It took me a long while to understand why it doesn't, but sadly it doesn't.

Anyway whatever you choose I wish you luck. I am so close to needing to do the same its scary. I have a number of inventions I want to protect, but it is an expensive and worrisome game.

Maybe you have discoverd a way to convert magnetocaloric effect into mechanical movement?

A magnetic material which enters a magnetic field, change its temperature. The change in temperature also change the magnetic properties. So you have a constant magnetic change which force the motor to run - just thoughts.
