If the person who wrote the ad couldn't afford a text editor with spell-check, how could the company afford to hire anyone at all?
There are at least a dozen spelling errors- obviously the work of an idiot trying to pull a scam...

   If they gave money up front and he didn't produce,
then you have a cut and dried "Breach of Contract".
Sue the ....... with a produce it or refund plus damages.
When he accepted the money, he agreed to a contract.
So enforce it.

Little Dickie has been hiring workers for his manufacturing plant for many years now. Now he is downsizing because he can't afford the rent.
